Fane Lozman to take on Department of Justice...

 ... and my money is on Fane Lozman.  The guy has gone to the Supreme Court twice and won twice.  It's pretty amazing.  This time, DOJ is hounding him about a floating home on his property.  Here's the letter he received:

I spoke to Mr. Lozman and he told me that he was going to respond to the DOJ with a letter that basically says "F*** off."  And that he did just that.  Here's the intro to his response:

Dear Brandon

Your letter, attached below, is a sloppy attempt to intimidate me.  Let's start with my answer to your settlement offer, that would require me to remove my floating residential structure from my homesteaded, private property in ten days. 

I am never moving my floating home off of my private property!

Your request is Un-American.  What country do you represent?

My floating home is not fill, which is usually rock and sand that is placed in submerged lands to create dry land.  Instead my floating home is the legal equivalent of a residential house built on land, as recognized by the State of Florida with my homestead designation, and the U.S. Supreme Court in its opinion, Lozman v. Riviera Beach. 568 U.S. 115 (2013). Both of my cases were argued at Georgetown's Supreme Court Moot Court program.  Did you really graduate from Georgetown law school, because that is hard to believe given the multiple grammatical errors in your letter and lack of comprehension as to what is Supreme Court precedent.  

And it concludes this way:

So go for it, criminally charge me along with pursuing a civil enforcement case, that you can set for trial.  Both the district judge and jury will think that you and Sydney are bullies and have wasted their time with your nonsensical pleadings. By the way, does Attorney General Merrick Garland know that you threatened me with your bullshit letter? Your flippant attitude for SCOTUS precedent, and lack of comprehension as to the limitations of 33 U.S.C.§ 403, reflects poorly on the Department of Justice.  I and others will make sure that it is formally addressed with Attorney General Garland and those in your direct chain of command.

His Supreme Court case is fascinating in its 5-4 decision because it was such a scrambled Supreme Court. You had the most liberal members like Ginsburg and Thomas on one side and liberal/conservatives on the other. I forget how each justice voted but it was the most scrambled Supreme Court decision in its history. Clearly justices were divided even in their judicial philosophies. If you saw his house boat in Riviera Beach, it was more than an eye sore and a danger to him and the community. He had lightening strike his way once maybe twice but I would not put my money on him again.

The letter is a bit wordy, but I am not sure grammatically incorrect. Between the two, his screed is far less grammatically correct. Good for him, but be careful what you ask for.

Job well done mr. Lozman, standing up for your private property rights. Corruption, collusion and intimidation is everywhere, city of Riviera beach learned their lesson 2x and now it's time for the d.o.j. to learn there's, they are not above the law. I'm a singer island resident , tax payer and u.s. citizen. I'm disgusted with my tax dollars being used to intimidate and retaliation against law abiding citizens, a lot of people on singer island and across the country are rooting for you and your friend in the fight , mr. Taylor....keeping going fane and stand up for your god given rights.

Wow, good for you mr. Lozman. Your an inspiration to all Americans who get bullied around by our own government, at the local,state and federal level. Doesn't the dept. Of justice have better things to do...I've lived in south Florida for many years and have followed the singer island mob tactics for decades, kudos to you and daniel taylor, another guy who has fought the fight for decades, praying for the 2 of you. Dont ever give up, you have alot of people rooting for you. God bless.

More power to you fane, city hall is full of corruption, especially district 4, always has been always will. Your entitled to your rights to use the property for single family residence and if not the city has to buy it, if there ever has been a taking case, this is it. The tiff deed spells out your vested rights that go back to 1924. My understanding is that all that property was dry when the state sold it in 1924, those primidonas and narcissistic people on the island need to understand equal protection under the law. Hello mr. Lozman, are you familiar with the david Lucas case out of south Carolina? Great taking case. Wish you the best, in regards to singer island and Riviera beach , my wife and I moved from there because all of the corruption and the waste of our tax dollars, fighting lawsuit after lawsuit and losing over 92 % of them, the worst city in the entire state of fl, hands down. Wish you much success.

Every decent law abiding American like you ought to have the right to keep un-moored 2-ton un-lighted concrete blocks along the shore of Munyon Cove. That allows the wind and tide to float them out to the navigation channel to potentially kill unsuspecting folks in speedboats. Reckless endangerment is the right of all real Americans like you. And destroying the ecology of Munyon Cove is a monument to your Supreme Court wins.

Galloping Gertie is a hefty 2-ton concrete block floating in the mangrove trees 1/2 mile north of Lozman's shack. Gertie plans to float all the ways to the Palm Beach Inlet to meet some nice boats head on.

Indeed, like Fane Lozman, one should be able to do whatever they want from their own property.

I happen to like to play around in my backyard with small solid fuel rockets. Not bragging, but my record apogee height this year was 2,295 feet.

The problem is that my neighbor complains to the police every weekend when I enjoy my rocketry hobby. He’s afraid my rockets will land on his property and kill someone. They never have! In fact, I’m an experienced rocketeer who has read many Scientific Mechanics articles on the subject.

My neighbor is a nervous prog. That's his problem! It’s a free country My property is mine to enjoy.
Perhaps my neighbor is not familiar with the writings of John Stuart Mill. He was one of the key authors of the Western concept of freedom:
In “On Liberty,” he wrote that freedom means “doing as we like, subject to such consequences as may follow, without impediment from our fellow creatures, as long as what we do does not harm them even though they should think our conduct foolish, perverse or wrong.”
To the best or our knowledge none of Lozman’s errant 2-ton concrete blocks have killed anybody.

I guess he’s not including the multiple times when the wind and waves have moved some or all of his his junk off of his private property and put lives and property in danger. Apparently, he doesn’t know how to properly moor his junk in place.

I think it should be noted that Lozman has never lived in or near the little shipping container at his site. There are no utilities (bathroom, water, electricity, gas or bed).

Obviously, by now, Lozman knows there is almost no chance that he will be able to build homes on his submerged land located in the special preservation area. If it can’t be developed the submerged land has little monetary value. Therefore, any future just compensation for an eminent domain takeover is probably less than what he paid for it. In my view, Lozman has a devious purpose for his flagrant actions i.e., allowing his structure to float across the lagoon, leaving many errant floating concrete blocks along the shore line, destroying mangrove trees, cutting down light poles, annoying the residents of Singer Island, etc. That purpose is to drive up the price of a potential eminent domain buyout. Perhaps he has hopes that a judge would agree to increase the eminent domain buyout amount over fair market value because of the dangerous situation, effect on the environment and the uglification of the property along a state highway.

Take a look at Fane's Galloping Gertie. She's one of several dozen chubby 2-ton floating concrete blocks that were not properly moored to Fane's site. Last I looked Gertie was about a half mile north of Lozman's shack.

Did you know that Lozman said that he is interested in placing floating structures in Lake Worth Lagoon at the shack Site with the purpose of displeasing people who live in condominiums in the vicinity of his site?

He also has said that he has purchased and parked dilapidated
painter vans in front of the homes of residents who have complained about his activities.

What's not to like about Fane? Ya gotta love a guy like him.

Give lozman and Taylor their right to develop or pay them, whatever they do will be 1st class and a asset to the area and generate new advalorme tax dollars to the city, tied of wasting my tax dollars fighting bs lawsuits over and over, word on the street is Taylor's lawyer beat down the city's lawyers on a recent case to renew his permits, wtf is the city doing , giving permits and then taking them back, unbelievable waste of time and tax dollars, pay them or let them develop, real simple. Speaking of lawsuits, the previous building official case is coming up, ms. Ladi march goldwire, wrongful termination for doing her job is going to cost the city a boat load on money.. Riviera beach wtf are you doing...
