FOR THE DEFENSE SEASON 4 FINALE, EPISODE 8
EDWARD SHOHAT FOR CARLOS LEHDER
It's the Season 4 Finale of For the Defense this morning with the wonderful Ed Shohat for Carlos Lehder -- one of the biggest (and longest -- 7 months!) drug trials in U.S. history. You can check it out on all podcast platforms (including Apple, Spotify and Google. All other platforms can be accessed on this website.)
It's been a really great and fun season, which included:
- Bruce Rogow for 2 Live Crew and Luther Campbell
- Mark Geragos for Susan McDougal
- Juanita Brooks for John DeLorean
- Gerry Goldstein for Richard Dexter (Deep Throat)
- Geoffrey Fieger for Dr. Jack Kevorikian
- Brian Heberlig for Ali Sadr and
- John Gleeson for The Holloway Project.
Thank you to all of these great lawyers for sitting down with me this season. Also thank you to Alfred Spellman and to Cliff Bumgardner for all of their support in producing this labor of love.

This opinion should be required reading:
https://storage.courtlistener.com/recap/gov.uscourts.cacd.841840/gov.uscourts.cacd.841840.260.0.pdf
The meat of it is in pages 3-11 and then 30-44.
In conclusion, the Court found that:
"Dr. Eastman and President Trump launched a campaign to overturn a democratic election, an action unprecedented in American history. Their campaign was not confined to the ivory tower—it was a COUP in search of a legal theory. The plan spurred violent attacks on the seat of our nation’s government, led to the deaths of several law enforcement officers, and deepened public distrust in our political process . . . If Dr. Eastman and President Trump’s plan had worked, it would have permanently ended the peaceful transition of power, undermining American democracy and the Constitution." at p. 44 ("coup" capitalized for emphasis).
Just one man's opinion.
@233: Nope, the Court's opinion. Which has the force of law unless reversed.
3:02 the force of law? A lot of hyperbole if you ask me.
Go tell that to the next federal judge you appear before,5:01. Love to hear the result.
7:27 I would take you more seriously if you ever practiced law
