Kevin Newsom confirmed to 11th Circuit

Congrats to my law school classmate Kevin Newsom on being confirmed to the 11th Circuit. The vote was 66-31, which is pretty incredible in this environment. He's very smart and well-qualified.

Judge Posner was right! Nothing but token appointments of women and people of color!
Oh wait, he is a white male from a pedigree law firm? Never mind.

I think the DOJ is going to have to expand their scope from colleges to make sure that white males aren't being discriminated against in judicial appointments.

So many haters! Regardless of his race, sex, or personal politics, Newsom is extremely well qualified to be an Eleventh Circuit judge. We should want the best persons to be judges on the courts in which we practice.

You make is sound like there were only 2 or 3 qualified candidates and that Newsome was clearly the most qualified.
The reality is that if you looked at qualified individuals in all of Florida, Georgia and Alabama you could easily find 100 or more equally qualified individuals such as federal appellate attorneys, law professors, state judges, federal judges (of the top of my head, I can think of at least 20 just in the Southern District of Florida) many of whom are women and people of color.
Given the make up and track record of this administration, it is safe to say that the fact that Newsome is a white male was seen as a plus. Given the history of the Eleventh Circuit and states who make up the 11th Cir., that is troubling.

10:41 - I totally agree. We should not stop until we find a wise Asian transgender polygamist to serve on the 11th. Also this blog totally lacks diversity because I heard DOM is a white male. Evil! We should at least limit the comments to politically-favored minorities!

There are 11 active judges on the 11th Cir and 7 senior judges (there are 12 active slots Newsom takes over for Hull). The 11th Cir was established in 1981 (I will not go into the history of the 5th cir before that). In its 36-year history, there has never been more than one African-American judge on the court at any one time. You can spin that any way you want or joke about it some more. But it is a very troubling fact.
