"When in doubt, affirm."

That's what Judge Moreno told Judge Jordan at his investiture yesterday, to much applause and laughter. Justice O'Connor spoke, as did Judge Dubina and U.S. Attorney Willie Ferrer.

Meantime, big news in the District. The U.S. Attorney's office has dismissed its case against Irfan Kahn, a case originally assigned to Judge Jordan but transferred to Judge Scola. Kahn was represnted by Federal Public Defender Michael Caruso and AFPD Sowmya Bharathi. Here is the press release from last year from the U.S. Attorney's office, which discussed taking down the Pakistani Taliban. There was much fanfare, including news reports around the world (and on this blog). Here's the NY Times article from last year detailing the arrest.

I wonder what press there will be about the dismissal.

Why would the USAO have to issue a press release, when they know your blog exists and will undoubtedly report on such matters?

Actually a very shameful comment by Moreno. Doubt about the legality if a conviction that lands a person in prison for many years? I believe justice cries for the opposite...but of course, that is why Moreno and Jordan are where they are.

Your post is misleading in that it creates the impression that the entire case was dismissed when, in fact, only one defendant out of six was dismissed.

Do you really think you can rely on this blog for fair and accurate reporting? We all know David is protective of his friends and screens comments accordingly. If any comment should cast his pals in a negative light, they are not posted. BTW, now that Judge Williams has done the right thing (much to your chagrin),you can kiss goodbye any chance you may have had on seeing some of your legal fees. Do you think Judge Martinez is going to find against the prosecutors? Ha, Ha, Ha, Ha, Ha. Hope you didn't spend all of that money in one place!

10:13 - the post is only misleading to someone who can't read. He clearly posted that the charges against one person were dismissed and then linked to stories that detailed many people had been charged. Learn how to read.

Weird, I can't find the defendant, Irfan Kahn, on PACER. Is this case completely sealed or something?

Uh, I do not think I would ever want to be in front of Judge Martinez accused of wrongdoing, no matter what side I was on. You really think he is not going to try and sort out what happened. Probably will go ahead and appoint a prosecutor as he is entitled to do under the law to pursue the contempt hearing.

My guess is Tein...

Totally agree. Judge Martinez has an impeccable sense of right and wrong and will be very tough on the prosecutors who clearly crossed the line.

No he won't. While thing gets swept under rug and David gets yelled at for suggesting thatcit still be pursued. Martinez will not appoint anybody to pursue the matter, he will hold a hearing and find nothing wrong.

2:14 ridicules any opinion he doesn't like if it's posted anonymously. Interesting, since he posts his anonymously! I bet he wouldn't call "sean" "gutless" if he had to post his real name. Talk about "gutless school yard bullies."

11:43 concluded that the Shaygan prosecutors "clearly crossed the line." Really? Gold's opinion and findings were slapped down by the Eleventh Circuit for his zeal in unjustifiably destroying the careers of two people. The 11th Circuit thought Gold crossed the line, no?

11:55 is right. Judge Martinez will find away to dispose of this without much effort. I think David has profited enough off the misery of others.
