Initial thoughts on Liberty City mistrial

1. Why are people so mean? I can't believe how crude and stupid some comments are. It makes me want to shut down the Blog. Should I get rid of anonymous comments again?

2. Will the next trial be called Liberty City 6?

3. Will there be a next trial?

4. Joel Defabio, the lawyer for the one defendant who was acquitted, will be partying tonight. A lot.

5. The other defense lawyers certainly can claim victory but I'm sure they are dreading the prospect of trying this again. That said, they will be celebrating too.

I can't think of anything worse as a trial lawyer than having to retry a case, except sentencing of course. It sucks as much for the prosecution too. And it's probably the worst for the judge to have to sit through it again.

6. How will this case be compared to the Padilla trial? Other than being 'terror' trials, they really are nothing alike.

Don't let the bastards get you down. Keep running the blog. 99.999% of everyone respects it and enjoys it. I suggest that if you are going out of town- or on a plane for a while- or going on a trip on my yacht for the day- just turn moderation on- and you can turn it off when you are in your office pretending to be busy. A little moderation never hurt anyone.

Your readers should discuss my thoroughly unscientific belief that the government wins 98% of re-trials.

Don't get rid of anonymous postings. Some of us (prosecutors) prefer to post anonymously. Plus, the comments on your blog are not nearly as bad as some of the postings that appear in the Miami Herald. The government will almost certainly retry the case; they're committed at this point and can't back out. Keep up the good work.

This trial was a loser from the start. These guys are just a bunch of thugs that thought they could try to rip off al-Quaeda.

Is "al-Quaeda" akin to Al Qaeda? I haven't heard of that one yet, must be very secret!

OMG did our favourtie federal blogger just get SPANKED by Milt Hirsch.

There was an email sent reminding everyone that there will be a seminar on ethics and law at the PD's Office on December 18. Albert Krieger and our own David Markus will speak.

Hirsch sent this email to the FACDL:

I intend to attend. As I understand it, Albert will present the position of the ethical attorney and David will provide the rebuttal.

I'm afraid of anyone who knows how to spell Al-Kada correctly. That's kind of suspicious. Just don't go around taking any oaths and you'll be alright. Notice how I purposely spelled it wrong myself.

F.U. Guy making fun of David. It is only ego if it is not warranted. How many trials have you won lately?

The joke about the ethics was funny because anybody that knows David (including Milton) would know that David's ethics are beyond reproach.

Now, prosecutors that are reading this may disagree - but don't forget people, prosecutors say that about anyone who beats them in trial. David just happens to have beat a whole bunch of them. When was the last time you saw a NG and the AUSA walk out of the courtroom saying, man, that defense attorney was really terrific and he was the straightest shooter I ever met. You do see that in State Court where there are some ASAs who have honor and integrity.

just wondering, how much do the bottom feeders on the liberty 7 case get paid per hour? for me to be involved in a 2 month trial the fee is in the 7 figures. the trialmaster

Are you suggesting that AUSAs have no integrity? If so, that is palpably ignorant. And yes, I am an AUSA and yes, I have lost a case, shook hands with the defense lawyer and told them he did a great job . . . and meant it!

I would have admitted to that. But, you still don't know how to spell the most used noun by your administration. By the way, you must be very proud of the "obstructions of justice" department you are working for. Are you going to appear before congress as part of the CIA defense team?
