BREAKING -- Judge Ungaro throws out Bank Atlantic verdict

Big big news at the close of a busy Monday -- Judge Ungaro has issued this well-written and researched 112-page order (also below) granting Bank Atlantic's post-trial motion for judgment as a matter of law. [HT:RR]

A jury back in November found Bank Atlantic officials misled shareholders on conference calls and awarded $2.41 a share to investors who bought the company's stock in 2007. If the verdict was permitted to stand, it would have been a tough hit for the bank, so this was a biggie.

Huge win for Gene Stearns and his team -- Adam Schachter, Cecilia Simmons, Grey Mead, and Andrea Nathan. I'm still digesting it, but the principal basis of the order was insufficient proof of loss causation and damages. In the event the order is vacated or reversed, the motion for a new trial was denied. I predict that the plaintiff's lawyer Mark Arisohn won't be getting much sleep tonight.

Judges Graham and Ungaro recently participated in a training program for Judges, lawyers, law enforcement personnel, court administrators and others in Jinja, Uganda. Beth Sreenan also participated as the DOJ representative. From what I understand, it was a great experience.

AFTERNOON UPDATE -- Very sad news: there's been a shooting at the Las Vegas Federal Courthouse leaving a court security office dead, and a marshal in critical condition. The shooter has been shot dead. The link above is from the local Las Vegas paper, which also has a video. Terrible news.

Former Atlanta Mayor Bill Campbell

Fascinating article from the Atlanta Journal-Constitution about former Atlanta Mayor Bill Campbell who is serving a 30 month sentence for tax evasion.

Apparently the Mayor tried to get out of prison early by faking an alcohol problem. In federal prison, you can be released early if you have a drug or alcohol problem (and otherwise qualify)and participate in an intensive rehab program. Campbell participated and was released early, but when the Atlanta prosecutors found out, they flipped and informed BOP that Campbell was making it all up. BOP yanked him back into custody.

Campbell filed suit in front of Judge Ursula Ungaro, but he then withdrew the suit. He's now back in...

District news

1. The Robles plea was accepted. Lots of news stories everywhere about it. There is a 15 year cap, instead of the 10 year cap previously agreed to by the parties. It will be interesting to see whether the government argues that a 10 year sentence is reasonable, notwithstanding the guidelines which I suspect will be a lot higher.

2. The Liberty City 7 case is underway. Again, lots of news stories about the jury selection and the start of the trial. Props to Judge Lenard for conducting a thorough voir dire. It looks like it will take a couple weeks to pick the jury in this case. That is appropriate considering the type of case it is and the press that has come with the case.

3. Last night Milton Hirsch had a constitution day party at his office. Here's the Joan Fleischman column about it. The office was packed with lawyers and judges. Federal judge sighting -- Judge Ungaro read the 15th Amendment, which states:

The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude.

I read the Fourth Amendment. Does anyone remember that one?

Federal Judges are people too

I love this story in So. Florida Magazine featuring our very own Judge Ursula Ungaro, who golfs in her spare time. How cool. Judge Ungaro, known as one of the smartest and sharpest judges in the district, can also hit the ball pretty well. Although she normally plays at the Biltmore or Granada, she has played as far away as George, South Africa where she "had to fend off the monkeys, who were trying to steal the balls out of [their] bags."
