Jack Smith moves to dismiss Trump document appeal in the 11th Circuit...

 ... but ONLY against Trump, and not co-defendants Walt Nauta and Carlos De Oliveira.

It's unclear who will handle the appeal for the United States after Jack Smith and his team are no longer involved.

And it's not altogether clear why Smith isn't moving to dismiss the entire case.

Certainly Trump's DOJ will not pursue this matter once they are in office.

It will be interesting to see how the defendants' lawyers handle it over the next few months and what the 11th Circuit will order.

Trump will pardon them. That simple.

I suppose Special Counsel wants Trump to pardon the co-defendants. Smith is only following DOJ policy where a sitting president cant be charged with a crim. It does not say co-defendants. But you would think he would beat him to the punch.

Biden should pardon them. He should have pardoned Trump, and maybe still should.

Pardons are a creature of law and their use does not undermine the rule of law. Pissed prosecutors and the public off.

A nation of laws? Hunter's pardon will be issued the day before Trump's inauguration.

Assuming that Hunter gets pardoned, as 2:05 correctly noted, pardons are a creature of law. This is about systems and process. POTUS has the unambiguous power to pardon. If you or I don't like that, fine; there is a lawful process to amend the constitution to change that. I am shocked at how many lawyers still confuse "what is right or good" with "what is lawful."

Yes fine pardons are lawful, the point is that Trump should not be pardoned because he has not taken any responsibility, suffered any meaningful consequence, or demonstrated contrition or rehabilitation. For those of you who jumped to the conclusion that my comment about the rule of law did not recognize pardons as lawful. And obviously I was expressing an opinion as to what should happen. Feel better?

Trump just got pardoned by a majority of the electorate. Get over it. I was all in for Kamala, but elections matter. Biggest acquittal in American history just went down. Respect the outcome and move on. There will be plenty more to worry about come February.

No. Voters were misled into believing there were no crimes. The election was therefore not a “pardon.” Not “getting over it.” I still believe in facts and accountability. An actual presidential pardon would send the wrong signal: that these things don’t matter. Yes things will be much worse starting in February. It all matters. Thanks.
