Motion to unseal search warrant

 Here's the motion, signed by the U.S. Attorney (Tony Gonzalez) and Jay Bratt, the Chief of the Counterintelligence section.

He’s already planted the idea that the FBI planted evidence. The sad truth is that no matter what is released and recovered a sold 35-40% of thus country thinks this lunatic can do no wrong. Watch and see if Lynn Cheney wins re-election. We are entering even darker times. His minions have already said that if elected on day one he will issue search warrants for Biden’s homes. And yeah - they’ve been quoted as saying “he will issue search warrants “ which shows you how much our judiciary and constitution are under assault.

There is a contingent of readers that think that something about this search is unlawful, or solely politically motivated, or otherwise somehow improper. I'd like, if possible, for one of them to provide a fact based explanation, please. I can't speak for anyone else, but I am open to hearing the facts of how/why this search was improper. So far, I have not heard any facts that suggest it was improper - which is not to say it was proper, just that like most pre-charge searches, all of the information is not yet public.

Can We Please Be Better?

I fully understand that this is both a legal and political issue. But there's an actual cost to others here too. Apparently, Temple Beth David has canceled a Beach Shabbat this week because of the deluge of antisemitic threats directed against Magistrate Judge, who signed the Mar-a-Lago search warrant and sits on the synagogue's board. On a social media site popular with white supremacists and antisemites—one poster said he was awaiting "the call" to mount an armed revolution. "All it takes is one call. And millions will arm up and take back this country. It will be over in less than 2 weeks," the post said. This is insane and has to stop.

A few years ago, the Harvard historian Jill Lepore published an ambitious and groundbreaking book, "These Truths." The book's outermost frame is a yes-or-no question: "Can a political society really be governed by reflection and election, by reason and truth, rather than by accident and violence, by prejudice and deceit?" ​

Based on our recent history, the answer to Lepore's question increasingly and depressingly seems to be "no." Like many of the problems impacting our country, there's very little one person can do. But we can try. And there's no better time than now for our political leaders to set an example by stopping the overheated rhetoric and engaging in civil discourse. Lives are at stake.

@Michael Caruso: I would encourage you to look at people like Sen. Ben Sasse and Congressman Peter Meijer. I have been described by my friends as a "liberal" (I will never understand exactly what that means). I have donated money to both of the republicans listed above. In the past I also supported John McCain and Carlos Curbelo.

If we want a civil society, the first thing we have to is support people who's ideas for governing we may not like but who value civil society, working across the aisle and who genuinely put country above political affiliation. If we cannot support well meaning people of good faith on the other side of issues, they will never support us.

Btw, Congressman Meijer just lost his primary to a Big Lie candidate who got money from the DNC(!) because the DNC cynically believed that supporting a radical crazy person would help them take the seat. This is not how good government in a democracy works.

Caruso is spot on. The nonsense and vitriol being spewed about Reinhart is horrible.

Gotta also agree with 10:37 that DNC support of Big Lie Maga candidates is cynical. It will come back to bite them in the ass. How can you assert these sorts of candidates essentially pose a threat to the republic and then fund their campaigns, thereby, amplifying their lies and the very threat and conduct you claim to abhor. When it comes to certain issues - like the Rs support for fascist Trump crap - I disagree with the both sides arguments, but, on this, the DNC is a fraud. Sometimes (or many times) both sides really are a disgrace.

All this talk about the warrant strikes me as bullshit. I want to see the affidavit in support of the motion. I bet Trump would prefer we do not see it.

Am I the only one who notices the rich, rich irony that Donald Trump once lead chants of "lock her up" over Hillary's cavalier handling of classified communications.

For what it's worth, I thought that Hillary's handling of "the emails" was irresponsible but that we should not make a mountain out of a mole hill. I suspect that the same is true of the current Trump document search. Hillary and Trump are people who had lawful access to the materials and who did not leak them to enemies. Plus, they were both people in roles of enormous responsibility and I think we can cut them both some slack for losing track of proper paperwork procedures. In both cases, just clean up the mess and get over it.

To the MAGA readers, how does it feel now that the shoe is on the other foot?

I thought all if this was about releasing the affidavit. Without the affidavit we don’t know anything really other then what they seized and all that is going to say is “ box with papers “. It’s not like they’re gong to list a box with papers on Minutemen ICMB launch codes.

Is there any reason the government couldn't have obtained and executed a writ of replevin if this was really about returning government property to the government? Seems like it would have been less controversial and the government wouldn't have had to make it about a criminal investigation.

@335 - that's a fair question. But I think the whole point of the warrant and affidavit being sealed is that the answer to that question is not currently available to the public. Until the warrant and affidavit are unsealed, we won't know.
