News and Notes

1. Pharmed sentencing: 9 years, top of the guidelines. From the Herald article:

Saying she was concerned about maintaining community values, U.S. District Judge Patricia A. Seitz Wednesday sentenced Carlos and Jorge de Céspedes to nine years in prison.
Despite testimony that they had given millions to charity, the judge decided the brothers -- who built up and then destroyed the Pharmed medical supply company -- should be sentenced at the top of the recommended guidelines of seven to nine years.
She said the brothers had been ''two-faced for too long'' and noted that the fraud against Kendall Regional Medical Center had gone for 14 years. The brothers had also pleaded guilty to a count of tax evasion. They will serve the sentences concurrently.



2. Helio Castroneves: The already great legal team adds superstar Roy Black to represent Helio along with David Garvin. Roy's partner Howard Srebnick represents sister Kati, and Bob Bennett and Lily Ann Sanchez represent the third defendant, an attorney. AUSA Matt Axelrod represents the government.

    Criticizing poor lawyering is not hate. The sentencing in question was a no-brainer to result in high-end of Guidelines sentences. The defense lawyering was a ridiculous disgrace.

    The blog administrator should stop covering up for attorneys he knows and wants to please. All you "big name" attorneys (who really are mediocre and even lousy) should own up; you do not deserve the praise or protection of someone who is a really good lawyer.

    Oh, if the public only knew that lawyers buy their way into the "best lawyers" books.

    Without the contributions of those persons whose comments you deleted, this blog would be a big fat zero. When the administrator stops praising his buddies, etc., with bull, the negativity may stop.

    Oooh. Bob Bennett. Really? The real, live Bob Bennett? The same guy who penned that poorly written autobiography to his greatness? The same guy who has not tried a case in . . . how long was that? 20 years? Or was it 30 years? The same guy that advised Clinton on his Paula Jones civil suit strategy and represented the President at his deposition where he lied under oath about Monica Lewinsky? That turned out well. And didn't Mr. Bennett's last client he had in court get held in contempt and sent to jail . . . until she then turned on Scooter Libby? Gee, she came out smelling like . . . um, well, okay, that didn't turn out so well either. How does this guy still get clients?

    Hopefully the defendants will collectively add more of these legal eagles to the docket sheet. The more, the merrier. I am glad to see the government has kept its team relatively streamlined: Matt Axelrod.
