Breaking— White House to nominate 3 today for open seats (UPDATED)

UPDATE -- The White House made it official here.  Congratulations to the three nominees!

I have it on good authority that President Biden will nominate Jackie Becerra, Melissa Damian, and David Leibowitz today. Congratulations to three great people. 

My understanding is that a deal was struck so that Detra Shaw-Wilder will be nominated next in Judge Scola’s seat — he took senior status yesterday. 

Let’s see if this actually pans out and whether the Senate can confirm them before the end of the year. 

 UPDATED -- And in the Middle District, Biden is nominating Julie Sneed.

    How things change. In the SDFLA for decades, Magistrate Judges would apply to be nominated to the District Court bench and unlike in other districts, they would just not make the cut. The surest way to the district court bench in our district was to have been a sitting state court circuit judge. It is great that our awesome Magistrate Judges are being recognized and being nominated to the district court!

  4. Wait! Aren't we within 10,000 days of the next election when a democratic president is sitting and as such under the RRS (Republican Rules Of The Senate) no such judicial nominee shall be considered?

    The qualifying factors for the RRS to apply are
    1) Democratic president;
    2) Judicial nominee;
    3) Presidential election within ten years of date of the nomination.

    So will they really be allowed a vote?

    Yes, Rumpole, McConnell said Dems can't appoint judges in years that start with the number 2.
