BREAKING -- WH nominates Embry Kidd to the 11th Circuit

 Here's the release:

Judge Embry J. Kidd has been a United States Magistrate Judge for the U.S. District Court for the Middle District of Florida since 2019. Judge Kidd previously served as an Assistant U.S. Attorney in the U.S. Attorney’s Office for the Middle District of Florida from 2014 to 2019. From 2009 to 2014, Judge Kidd worked as an associate at Williams & Connolly LLP in Washington, D.C. Judge Kidd served as a law clerk for Judge Roger L. Gregory on the U.S. Court of Appeals for the Fourth Circuit from 2008 to 2009. He received his J.D. from Yale Law School in 2008 and his B.A. from Emory University in 2005.

    Well obviously somebody thinks that being a prosecutor is a prerequisite to being a circuit judge and that’s why we end up with a circuit court full of prosecutors, with just one exception.

    These comments are so lame, focusing on only one aspect of Judge Kidd's background. Let's recount the others: top law school; clerked for a circuit judge (i.e., the exact position for which Judge Kidd has been nominated); worked for one of the best litigation firms in the nation; yes, was an AUSA; and has been a magistrate judge for five years. What's more, Judge Kidd actually resides in the Middle District of Florida (thus being a natural replacement for Judge Wilson's seat); he's young, so he'll have an opportunity to influence the court for many years; and he's Black (which, even if that's not something that you care about, President Biden clearly does). For a Biden administration selection for a circuit judge nominee, the case for Judge Kidd is open and shut.

    7:25 I think you aren't seeing the bigger picture. Yes, Judge Kidd appears to be a superior nominee. But over many, many years, it seems to get any federal judicial appointment (magistrate, district, or appeals) in our area, you must have AUSA on your resume. It's particularly frustrating now because Biden specifically pledged to put more public interest and public defenders on the bench and he hasn't delivered here. (Abudu being a notable exception). That's all. Judge Kidd looks like a great choice.

    10:03 AM, 7:25 PM here. Completely agree. (I don't believe that Kidd's having been an AUSA was likely a factor either way in his nomination, but I understand and agree with your point.)

    Anyone have an idea yet on if Scott/Rubio are supporting? I know its not required but that would go a long way towards speedy confirmation
