Judge Cannon orders appointment of Special Master

You can read the whole order here.

Random thoughts:

She asks the parties for recommendations on who the special master should be.  That will be an interesting list.

DOJ will surely appeal and ask for a stay.  Will they get it?

Are we now going to see a slew of folks filing lawsuits asking for special masters?

    Perhaps only from former presidents which should cut down the volume. Normally one would expect the appointment of a retired federal district judge or magistrate, but in light of the fact that a former president is involved, that should militate for a constitutionally appointed, retired judge. Judge Scott is presumably disqualified because his firm is involved. Judge Ungaro would no doubt disqualify herself to avoid offending half of her future client base. If one were to reach into the state system, perhaps recently retired Florida Supreme Court Justice Alan Lawson might be a potential master or perhaps a retired federal judge from outside of our district maybe even Justice O'Connor.
    In any event, I think that Judge Cannon's order is quite respectable and the Government's indignation at having its screening panel's determinations second guessed would be more impressive if the DOJ were not leaking information like the Titanic in its final minutes.

    Who cares and why appeal? Just get on with it. Appeal the decision of the special master and judge if you don’t like it. This whole think should not take more than 10 days. And yes, I am filing motions in every case there is a seizure and a taint team.

    Dear Cannon: Follow Canon 1...An independent and honorable judiciary is indispensable to justice in our society. A judge should maintain and enforce high standards of conduct and should personally observe those standards, so that the integrity and independence of the judiciary may be preserved.

      Have any of you people leaving negative comments even read the Order? Reminds me of Judge Singhal’s class he teaches at law school. (1) How many of you have commented on whether Dobbs was correctly decided? ALL hands go up. (2) How many of you have read Dobbs? NO hands go up.

    This decision is a joke and a disgrace. Every defendant would love to ask for a special master and it would never happen. Its just really sad. A federal judge stopped a federal investigation. Someone go find where a judge did this before. Save you some time. How about NEVER. One justice system for rich and powerful and the other for the rest of us. Last week I even made a joke here about even asking for one because in my wildest dreams I thought that even a biased judge would not want to be overturned and look political. I was wrong!
    This will never end. Trump atty will never agree to who is selected and this just eggs on months and months of silly litigation to serve nothing but to slow and stop the investigation.
    Rule of law. Where are you? Defenders of the rule of law. Where are you?

    This is a side show and bad for the health of our nation. Biden should pardon Trump and we should move on.

    This is the Hilary emails all over. Stupid.

    Did Trump give the docs to anyone who shouldn't have them? So far, I haven't heard that he did. The allegations that I am aware of are that he mismanaged paperwork. He (like Hilary) had a challenging job. Mismanaging paperwork (or emails) is easy to do and could (but didn't) have serious consequences. But the system worked. The people charged with managing documents figured it out. The documents were returned (the server was destroyed) and no harm was done. Move on.

      @9:48…. From what I’ve read, documents were repeatedly withheld without cause. And following a search, some documents so withheld have been found. Has everything been found? We don’t know. But since documents sought were recovered we do know that not everything was voluntarily returned. So there appears to be wilful conduct here, and refusals to cooperate. All of which is beyond mismanagement.

    This is 9:38 - I consider myself a moderate centrist, although likely with a left of center tilt. I have supported with votes and money Republicans (McCain and Curbelo) and Democrats (Clinton, Biden, and Obama). I admire many republicans that I did not vote for (Romney and Papa Bush). I would sooner vote for a chimpanzee than to vote for the likes of Donald Trump or Ron DeSantis, and perhaps would vote for Marco Rubio if the only other options were Trump or DeSantis. This is not a partisan issue and making it one is a disservice to the nation, and this fight is damaging our country and our democracy. Stop it.

    What harm has occurred? Seriously. Is there ANY allegation that Trump has given government secrets to an enemy? He's a former POTUS and still has top clearance and regular security briefings. The question and answer from 1013 blows my mind - "Has everything been found? We don’t know." Indeed, you don't know and have no evidence of any other documents being withheld - all you have is a burning hate and distrust. Stop it.

    @632 and 1013 - you guys sound exactly like the Trump crazies. Next (if not already) you'll be chanting "lock him up". This is not a third world country. We don't imprison our political adversaries. Seriously, take a deep breath and stop it.

    I would like to formally nominate Michael NMI Caruso to be assigned as special master. Like Judge Cannon, he is known as someone who is not just a rubber stamp for the government. Plus, he has a security clearance.

    This judge announced a preliminary ruling without even hearing from the Government. The whole thing stinks. Government can appeal (which buys Trump his desired delay) or attempt compliance
    (which buys Trump desired delay as he fights over the master, selection, terms and anything else dreamt up). Special law for special people.
