"Public defenders often have a natural inclination in the direction of the criminal."

That's Senator Ted Cruz ... I was going to write unbelievable, but I guess it's not.

By his standards no defense attorney or public defender can be a judge or even be a prosecutor. They are all criminals.
Seriously, cant we all agree the best judges were both defense lawyers and prosecutors. The best defense attorneys are usually former prosecutors too.

The case can be made that former PDs are harsher sentencers than ex-prosecutors. The ex-prosecutor looks at thousands of cases, both crappy soon-to-be-nolled, and those filled with excellent police work and a confession. They look at the big picture.

The PD, by contrast, is in direct contact with some pretty loathsome creatures. They have much closer contact with criminals.

When it comes time to sentence the PD's direct experience with nasty criminals makes them more likely to swing the hammer hard.

I wonder if Judge Moreno has anything to say on this subject.

The best defense lawyers are not former prosecutors. Exhibit A is David O. Markus.
