Breaking -- Andrew Brasher confirmed to the 11th Circuit
Another lighting fast confirmation. The vote was 53-43.
OMG you gotta read the stone sentencing memo fiasco. The line trump hating prosecutors wanted to enhance stone all the way up to 29, double! the starting offense level, and somehow argued with a straight face he should get up to 9 years! in the slammer. Then the adults at DOJ step in to to provide some sanity and at least one of the line prosecutors (zealots) RESIGNS! LoL. I can just see this idiot--"if we dont get to argue for 9, i resign." Really...the guy lied to congress and sought to get his buddy to take the fifth, and think about this, the zealot RESIGNS becasue he cant argue for close to a decade of prison time! Interesting to see how the obama judge will respond...act like 9 years is somehow reasonable, or call it what it is...total BS.
Stones attys should immediately pull all this prosecutors sentencing memos arguing for less jail, and i bet you will find a few characters much more unsavoury than nobody roger stone. Just a hunch...
Perhaps even crazier than arguing that stone should do more jail that Manafort's combined sentence of 7.5 years for two cases is the utterly ABSURD suggestion that the obama judge should take into consideration that despite the gag order, stone posted a photo of the judge with crosshairs next to her head. The judge could have punished stone by holding him in contempt for that because he violated a court order. But it wasn't and isn't offense conduct in a false statement and obstruction prosecution. Not even 3553--come on now. But for the gag order, the post is protected free speech. When i saw 9 years and read the prosecutor's overt attempt to appeal to the judges desire for some type of personal revenge for the crosshairs post, i almost puked. These prosecutors are total children. Good riddance!
