In less exciting news, Chief Judge Moreno has abolished the bankruptcy appeals case assignment wheel in administrative order 2014-57: "After consideration of relevant circumstances and after consultation with the Judge of this District, the Court has determined that the administration of justice at this time would be best served by returning to the purely random assignment of Bankruptcy Appeals that existed prior to the establishment of the pilot project for assignment of Bankruptcy Appeals."
Meantime, the Court surprised Judge Moreno with a party last week, recognizing his incredible 7-year tenure as Chief Judge of this District. Amazingly, Judge Moreno seemed genuinely surprised, which was cool. Here's a picture by 3rd DCA Judge Kevin Emas of yours truly and Judge Moreno:

Gayles should send Will Thomas a bottle of Blue Label every year at Christmas. But for Marco blocking Thomas & Obama wanting another gay black man on the Federal bench, Gayles would have never gotten a lifetime appointment. Thornton, Lopez and Trawick were all better qualified candidates. The whole JNC process is more political than the that of state judges who actually run campaigns.

Thornton will never get it. He wants to be everyone's friend, not a judge. The irony is, federal judges rule decisively without regard to whose political feelings they might ruffle. John can't make a timely decision and when he belatedly does so, he splits many babies in many parts . He's not qualified to be a federal judge. Hes right where he's supposed to be - flagler street. He's also aged out at this point.
ReplyDelete11:02 -- Yes, the who process is disgustingly political. And yes, for every person who gets nominated (for *every* person; take out Gayles's name and put in the name of any other nominee), there are others who are objectively more qualified. But that's just how it is (sadly, even at the appellate-court level (though fortunately at a much lesser level), where the judges make the law and therefore you want to be objectively more qualified). It's incorrect to imply that there is anything special about Gayles's nomination; it's the entire process.
ReplyDelete8:33 -- are we talking about the same Thornton? The one who is consistently rated the top judge in the state system? And to say he is "aged out" is ridiculous - look at the last crop of nominated judges from around the country. More than one in early 60s.
ReplyDeletewhy nominate an old person who is going senior in a few years when you nominate a good middle aged judge who will be around a while to learn, develop, etc.
ReplyDeleteI hate the panels where the judges all sound reasonable and flexible, then you try a case in front of them and they are inflexible and dogmatic. They have life tenure, why give a shit if people like you or not. In that regard, Moore is the best, what you see on a panel is what you get in court.
ReplyDeleteJudge Gayles is highly qualified and enjoyed a great reputation in the state system. He has earned his seat and the fixation on his personal life is distracting and juts stupid.
ReplyDeleteAlso, if I remember correctly, Judge Gayles's nomination and Judge Bloom's nomination were both made while Judge Thomas's nomination was pending and were for different seats.
From my perspective the challenge is to replace Judge Gayles on the circuit bench with a candidate with as fine judicial qualities as he posseses.
