Update-- to answer the questions in the comments, per Glenn Sugameli, the only No votes (GOP Sens. Lee [UT], DeMint [SC] and Paul [KY]) were from those who have been continuing to vote NO on all judicial nominees in protest of three President Obama Executive branch nominees

ReplyDeleteActually, it's to protest the President's appointments (not mere nominations) under the recess clause (U.S. Const., art. II, sec. 2) at a time when the Senate was arguably not in recess -- though that's a discussion/debate for another day. Congratulations to Judge Rosenbaum.

ReplyDeleteThe Arizona immigration case out of the SCT shows you cannot predict the outcome of an appeal by what happens at oral argument. Interesting dissent by Scalia sounding more like a politician than a SCT justice. Also interesting since Scalia is the son of a Sicilian immigrant who overstayed his student visa (things were more lax back then). That makes Scalia an Anchor baby writing about the evils of illegal immigration. Makes you laugh -- unless you are brown with a latino last name living in Arizona. Better take your passport with you Ese.
