As a criminal defense attorney, I'm sad to see Alex go. That is because the U.S. Atty's Office was losing such a high percentage of cases under him. I'm afraid that that office might become more competent now. Alex, can you stay for a few more months?
Fake John Harlan--they're talking about the Ricci case involving the New Haven firefighters. The phrase "reverse racist" is a colorful turn of phrase used by white people to describe affirmative action policies. All these Republican jokers are wasting their time; she is going to get confirmed. First, she is replacing a liberal member of the court as opposed to conservative one so the balance of the court is not really at stake. Second, the Republicans are not going to further alienate the Hispanic vote (NOTE: Obama received 67% of the Hispanic vote while McCain received 31%--significantly lower than the 43% Bush captured in 2004).
My understanding is that the city rejected the firefighter exam because the test violated Title VII. Ricci's claim is that the city's effort to comply with Title VII is itself race discrimination (under the 14th Amendment to the Constitution and under Title VII itself).
My question is this: which argument is worse - Ricci's or the lawyer who filed that crazy boat pleading below?
So what now? When does Alex Acosta step down? I heard that today might be his last day (not sure if there is any truth to that). Any credible rumors on who might be next? Does someone from within the office step up as the interim USDA? If so, who?
