Marcos Jiminez has posted comments responding to the DBR editor and to "anonymous." Here are the comments:
COMMENT #1"Anonymous" should listen to the tape and write us about it for attribution. Otherwise, any comments by someone named "anonymous" are laughable and cowardly. Posted by Marcos Daniel Jimenez to Southern District of Florida Blog at 3/20/2006 11:19:30 AM
COMMENT #2 My response to the Editor is simply this: anyone listening to the tape will agree that the DBR misconstrued my remarks in a sloppy and disingenuous fashion just to create an attention-grabbing opening. This made for such a confusing introduction that the DBR felt obliged in the third paragraph to notify the reader that I was actually defending the Bush administration during the debate. The Editor's response likewise selectively quotes my statements in order to downplay my defense of the administration's actions.
These attempts to twist what is said on these issues are obviously slanted and somewhat humorous. It reminded one of my colleagues about a recent ABC Stephanopoulous show interview of Sen. Specter:
STEPHANOPOULOS: You know, if the president did break the law or circumvent the law, what’s the remedy?
SPECTER: Well, the remedy could be a variety of things. A president - and I’m not suggesting remotely that there’s any basis, but you’re asking, really, theory, what’s the remedy? Impeachment is a remedy. After impeachment, you could have a criminal prosecution, but the principal remedy, George, under our society is to pay a political price.
You know what the headline was the next day in the LA Times? You guessed it: Arlen Specter: "Impeachment is a remedy"

Would the participants consent to Ms. Kay making the audio of the debate available on this blog? I think this will go a long way to clearing the air.
ReplyDeleteBy the way, regarding Mr. Jimenez' comments about the program being "plausible and defendable," interested readers should review David Kris' memorandum on the subject. Mr. Kris was DOJ's Associate Deputy Attorney General in charge of national security issues from 2000 to 2003 and has a view contrary to Mr. Jimenez. His memo may be viewed at http://balkin.blogspot.com/2006/03/thorough-debunking-of-stat_114195035963469598.html.
Not to be a nitpick or anything, but "the participants" have no say in whether the audiotape is posted on this website. It is the sole property of Ms. Kay (or perhaps the DBR), not any of the program participants who willingly allowed themselves to be recorded by a member of the press at a public meeting. So if Ms. Kay is game for turning over a copy of of the recording, the public can decide whether she slanted her article to make it more attention-grabbing, or if Mr. Jimemez is now trying to cover up for having candidly spoken out against his former employer.
ReplyDeleteWho cares? Bush should be impeached and Jimenez should be embarrassed for trying to back away from what appeared to be an honest and candid statement. Is it too much to expect that a Former US Attorney would have enough conviction to stand by the things he says? I am sure at the time he was quite happy to recieve credit for making the comments in front of a bunch of intellectuals who agree with the position; now it seems that he is afraid of political fallout from an administration not intelligent enough (or just plain wrong on the facts) to appreciate a truthful statement about our governmental process.

Which anonymous was laughable and cowardly? Nearly everyone who comments on a blog chooses the "anonymous" option. Only those who love to see their name in print bother to seek attribution for stirring the debate. It must be tough, Mr. Jimenez, now that the media doesn't cover your mistakes and you don't have the power of a grand jury to investigate those with whom you disagree. Welcome back to the life of private citizen.
ReplyDeleteThanks. I'm glad to be back as a private citizen. Although it was a great honor to serve my country as United States Attorney, and I miss my former office very much, I'm enjoying private practice with Kenny Nachwalter immensely. And I'm enjoying stirring up the pot on this blog immensely. And I'm proud not to be "anonymous."
ReplyDeletei was in attendance at the debate and agree with our former united states attorney that the dbr article mischaracterized the tone and tenor of his comments. mr. jimenez took a position that was whole-heartedly pro-administration, and to lead with his comment about impeachment, which really was talking about it as the remedy of last resort, was misleading, even if textually accurate. context matters. to those anonymous posters who made it personal, you lose credibility by hurling personal invectives at mr. jimenez, who from my personal experience, is not only a very smart guy, but a nice guy as well. on the other hand, (as tevye was fond of saying) i don't share mr. jimenez's sentiments about the use of anonymous posts. it is much easier to post anonymously than to go through the steps needed to set up a blogging account. and, i would not be surprised to learn that mr. jimenez has revised his views on that point as well.
ReplyDeleteI think the last anonymous poster is actually Mr. Jimenez.
ReplyDeleteTheir are lots of things our gov't does that we dont agree with. Yet we let it happen it is all of our own faults for letting them break away at our constitutional rights.
ReplyDeleteJust one small example,
have you ever tried to buy a gun?
you are a normal American Citizen with no arrest record and you have to wait. Meanwhile out on the streets the thugs go and buy their guns that day that minute.
The same gun you bought and had to wait three days to get.
I feel no shame in what our country is becoming. However i do feel pity for the next generation getting strip searched to walk into a mall.
yeah we are free all right.

this is the anonymous poster (the quoter of tevye) who came to the defense of mr. jimenez. rest assured, that post was NOT made by mr. jimenez, who to my knowledge, is not that well-versed in Fiddler on the Roof. it was actually a bipartisan post from someone intersted in a fair and fairly represented discussion of a very important issue. remember that in the heat of battle, this country has often made mistakes in sacrificing liberty for the appearance of security - while we must be vigilant, we must be wise as well, lest we do our enemy's work for them and take away our own freedom.
ReplyDeleteYTrdWK The best blog you have!
ReplyDelete1DDBNm Nice Article.
ReplyDeleteactually, that's brilliant. Thank you. I'm going to pass that on to a couple of people.
