No other circuit uses the clunky, expensive system adopted by the 11th. This simply reflects how entrenched in secrecy the 11th is. Their CD-by-order program is outrageously expensive and is designed so that very few oral arguments ever get revealed. What are they afraid of -- one of their not-so-brilliant questions will be heard by the public? Or, their one-sided approach to most cases will be evaluated by the public for fairness?
